Within the borders of South Africa, according to our constitution and as a democratic society, we have the right to a free flow of information. We also, however, have a right to privacy which is limited.
That right to privacy includes:
- Bodily privacy,
- The privacy of communications, and
- Territorial privacy
Does South Africa have a data regulator?
The Personal Protection of Information Act (POPI or POPIA) will essentially become the Data regulator for South Africa. More on POPI
Is anything in the public space considered "private?"
Similarly, nothing in the public space is considered private. Let’s use a practical example: When it comes to territorial privacy when your car leaves your property, it is now in a public space and anyone who sees your car can capture the license plate details, for instance. POPI will regulate what they decide to do with that information.
